【Protection of Victims and Participation in Proceedings】Enhancement of the Rights and Interest of Victims and Strengthening of Protective Measures in Criminal Cases
To enhance the agency of victims and to protect their dignity and needs in the litigation process, the Judicial Yuan had proposed the amendment to the Code of Criminal Procedure regarding the victim protection and proceedings participation system. (The amendment was passed by the 166th session of the Judicial Yuan and the third reading by the Legislative Yuan on December 10, 2019). It was promulgated on January 8, 2020 by the President and effected on January 10, 2020. The content of the amendment is as follows:
▍1. General Rules on Victim Protection
This includes the protection of the privacy of victims and their families; appropriate separation and protection of victims from the accused, attendees to the hearing or any third parties; persons to accompany the victims if consented by the victims; to order the case to undergo mediation or a restorative justice program during investigations or trial procedures.
▍2. Proceedings Participation System for Victims
Victims have the right to appoint their own representatives or have the representatives designated by the court; the right to access the information of case files and evidence; the right to be informed of dates and to attend the proceedings; the right to appoint representatives for proceedings participation; the right to express opinions concerning preliminary proceedings, evidence investigations, and sentencing ranges.
