【New System of the Disciplinary Chamber of the Judiciary】The Disciplinary Chamber of the Judiciary now is under the Disciplinary Court and applies the “one court, two instances” system. The first instance disciplinary case of judges will be adjudicated jointly by the collegial panel consisting of professional judges and expert lay judges, where they listen to diversified perspectives

The amendment of the Judge Act concerning the Disciplinary Chamber of the Judiciary, which was promulgated by the president on July 17, 2019, was effective on July 17, 2020; meanwhile, the Disciplinary Court Organization Act was amended and renamed the Public Functionary Disciplinary Sanction Commission to the Disciplinary Court. The new system’s features are as below:  


  1. The Disciplinary Chamber of the Judiciary has been reassigned from the Judicial Yuan to the Disciplinary Court to meet the operational needs.
  2. The Disciplinary Chamber of the Judiciary has implemented the“one court, two instances” court system. You may appeal against the judgment of the first instance in 20 days after the service of the judgment; the second instance reviews solely on the matter of law and must decide on the case in 6 months.
  3. When the first instance of the Disciplinary Chamber of the Judiciary hears from cases against judges or prosecutors, a collegial panel that consists of 3 professional judges and 2 expert lay judges will conduct the adjudication, providing diversified perspectives into decisions on cases against judges. The expert lay judges are eligible to participate in every adjudication and review during the process of the first instance; they have the same functions and powers as judges and exercise their duty independently following the law without any interference.
