【Increasing the Maximum Headcount of Judiciary Branch】The increase of 1,100 personnel in judiciary branch headcount to accommodate the potential workforce for the judicial reform, solve the shortage of staff, and improve the quality of adjudication

  1. With the growing concern on individual rights plus the more sophisticatedand increasing sophistication of litigation process, the resulting heavying caseloads for courts not only made it hardhave become too heavy to satisfy the parties' expectations: to resolve disputes efficiently and promptly. Also, but also the heavy caseloads have jeopardized the quality of service provided by the judiciary. Recently, legislators have passed several bills on judicial reform(including the Labor Incident Act, which had become effective on January 1, 2020, to establishing special courts for labor cases; the Constitutional Court Procedure Act, which will take effect on January 4, 2022, towill reshape how justices review their cases by adopting new procedure, court organization, and form of the decision that are similar to the general court; the amendment of Code of Criminal Procedure and its following new systems: protection of victims and their participation in proceedings, escape prevention mechanism, and reform on retrial; the new Juvenile Justice system; and the new urban planning reviewing system, etc.), which created a strong demand for more staff. That's why we have to break through the cap on the judiciary branch headcount prescribed in Article 4 of Act Governing the Total Number of Personnel Headcounts of Central Government Agencies.
  2. The Legislative Yuan had passed the amendment to Article 4 of the Act Governing the Total Number of Personnel Headcounts of Central Government Agencies on December 10, 2019; later, the Act took effect after promulgated by the president on December 31, 2019. With an increase of 1,100 personnel, the Act modified the maximum number of the judiciary branch headcount from 13,900 to 15,000, loosening the regulation on the Executive Yuan for adjusting the maximum number of the judiciary branch headcount within the cap number of central government agencies; however, the Act prohibited while prohibiting reduction of the headcount.
