I. Copyright

1.Except for subject matters that must not be copyrighted in terms of the Copyright Act (for example, laws, orders, and speeches and news releases drafted by civil servants - please refer to Article 9 of the Copyright Act), all narrations in words, photographs, pictures, recordings, images, and other information published on the Judicial Yuan Website (hereinafter called the Website) are subject to copyright protection.

2.Any person may freely exploit the abovementioned subject matters that cannot be copyrighted. All circles are welcomed to widely exploit them.

3.Where any content of the Website is protected in terms of the Copyright Act, and any person is required to obtain consent or authorization from the copyright holder of the work prior to using the content and apart from his, her or its fair use of the work, the person may exploit the work only after it has obtained the consent or authorization.

4.The above-mentioned 'fair use' is explained as follows:
(1)For works that are published in the name of the Judicial Yuan (hereinafter called the Yuan) on the Website, and whose authors are the Yuan, any person may reproduce, or publicly broadcast or transmit them within a reasonable scope. The person is requested to indicate origins of the works if he, she or it exploits the works.
(2)Individuals or families may reproduce information of this Website for nonprofit purposes.
(3)Any person may, within a reasonable scope, cite information of the Website to report news, comment, teach, research, or for other proper purposes. The person is requested to indicate the origin of the work if he, she or it exploits the information of the work.
(4)Please refer to Articles 44-65 of the Copyright Act for other fair use.

5.No person can remove or alter electronic rights management information indicated on the Website without authorization, unless the reason for the removal or alteration of the information conforms to Article 80-1 of the Copyright Act. The provision prescribes the following legitimate reasons for the removal or alteration of the information: A removal or an alteration of electronic rights management information of a work is unavoidable in the lawful exploitation of the work because of technological limitations at the time of the act, or the removal or alteration is technically necessary to a conversion of a recording or transmission system.

II. Linking to the Website

1. Linking any website to this Website does not need consent of the Yuan, but the link must clearly indicate the name of the organ. The Yuan prohibits the linking to its website if the link misleads users.

2. Linking a website to any webpage of the Website does not represent that the Yuan agrees with contents, products, services, or beliefs of the first website. Any person who or which creates this link is requested to open a new window, but not to use a 'frame' or an 'iframe' tag and alter the content of the webpage of the Website.

III. Linking to Websites Not Governed by the Yuan

1. For the convenience of visitors to the Website, the Yuan also provides links to other law related, government agency, or other suggested sites. However, the Yuan is, without exception, not liable for any person's use of the content of any of the aforesaid websites.

2. All webpages and information of websites that are not governed by the Yuan and are linked from the Website are provided by the websites, and the websites or lawful right holders own related rights over them. The Yuan does not guarantee the accuracy, instantaneity or completeness of the webpages and information.

This policy is established to maintain the credibility, availability and integrity of the information service and to comply with relevant legal requirements.

1.For the mere browsing and downloading conducts hereof, the Website will not collect any personal identity information. Using the online services provided by the Website requiring personal information from the applicant, the handling departments hereof will, according to the application, require the user to provide her/his latest and most genuine personal information, such as name, ID number, telephone number, Email address, and contact address. 4.The personal information collected by the Website will be subject to the Computer-Processed Personal Data Protection Law and the relevant laws and regulations. The Website will not provide the user¡¦s personal information by means of sale, exchange, or rental to other organizations, individuals, or private enterprises, except the conditions as follows:
(1)Cooperating with the investigation of justice.
(2)Cooperating with relevant governmental administrative officials in terms of investigation and uses subject to their duties.
(3)Pursuant to the needs of legal purposes under good will or the needs of management in terms of maintenance and website services improvement.

1.In order to maintain the information security of the Website, the Website has established security mechanisms to run the vulnerable scanning and system patch from time to time. The Website is also protected with a recording and analysis system to log the intrusion of unknown intentions. Any abnormal acts of sabotage behavior or intention to invade the Website host will be intervened and might be reported to the police.

2.Any person damaging the website’s information security would be pursued in civil, criminal, and administrative responsibility, depending on the seriousness of the infringement/offence.
